“Woman files lawsuit against AMR because passenger next to her masturbated while she slept
A 21-year-old Harris County woman filed a $200,000 lawsuit against American Airlines alleging employees on a flight to Los Angeles from Dallas/Fort Worth Airport failed to protect her while she slept from another passenger who masturbated to her and ejaculated in her hair, according to a lawsuit she filed last week in Tarrant County.
The Harris County woman alleges employees knew of the risks associated with failing to “police the passengers to ensure that passengers do not hurt one another,” the suit states.
Airline officials did not return calls seeking comment. In a statement to a Houston television station last year, a spokesman said the company regretted the incident, but the flight crew took appropriate action.
The woman and her lawyer could not be reached for comment. The Star-Telegram does not identify victims of sexual crimes.
Destined for a Spring Break visit with family and friends March 19, the woman flew from Houston to DFW Airport and had settled into her seat for the last leg of flight 2074 to Los Angeles about 11 p.m., the suit states. The woman slept most of the flight, but awoke about 20 minutes before landing when the pilot announced the plane was on decent into Los Angeles. When the woman opened her eyes, she saw that an unknown man had moved into the seat next to her and was staring at her as he masturbated, the suit states.
The woman turned toward the window in embarrassment and in an act of nervousness began to run her fingers through her hair where she noticed “a substantial amount of an extremely sticky substance in her hair,” the suit states.
The woman began to cry and tried to get the attention of a flight attendant, but was unsuccessful, the suit states. Finally a passenger in the row in front of the woman comforted her and verified the semen in her hair, the suit states.
When the plane landed, employee called airport police and the man was arrested.
The suit alleges that the during the investigation, American Airlines employees told police they witnessed the man move from his assigned seat into the row where the woman was sleeping.
The woman is seeking punitive damages and a jury trial.”
Now, I readily admit this is a foul, disgusting, violating and unfortunate incident for this woman. It will undoubtedly change her sense of safety and security in public. However, is it reasonable to sue the airline?
My opinion is no. My opinion is that people in this country need to quit being so god damned spoiled. Our society needs to wash it’s money grubbing hands and realize that sometimes shit just happens! Whether it’s spilling hot coffee or slipping in an icy parking lot, or being the victim of some disgusting jerk wad (bad pun, sorry), it’s life! But products of our lose-all-the-weight-you-want-and-never-go-hungry and get-rich-quick culture immediately look for the nearest Fortune 500 company every time something crappy happens. Frankly, I’m getting really sick and tired of the victim mentality which claims to need hundreds of thousands or even millions of dollars to compensate them for their troubles.
Press charges on the creep and move on, already.

I agree with you, the airline company is definitely not responsible. What I’d really like to ask about is the following statement noted in the story.

What method did they use to “verify” it was semen?

I live in Texas and we found that some of the broadcasters decided not to air the story - I think there was just too much of the gross factor involved, who wants to talk about masturbation, and cum, OMG, Ick!!!!
I cannot imagine the disgust and filth that woman had to feel, I’m gagging even now just thinking about it.
The airline is not responsible but that sick SOB and although he’s responsible for himself, I’m sure a jury would find him mentally unfit (who in their right mind would do that).

Where WERE the flight attendants? Odd. Gross. Creepy. Criminal? Not on the part of the airline, and to pull their butts out of the fire, they should absolutely rat out the male passenger.
Being naughty (because you know I am!), that sort of “stuff” is only fun if you’re in on the plan. Surprise = not cool. Serious ick-factor.

I definitely think this creepy pervert should have his name and picture released among the “Johns” who get busted for prostitution, along with other sex offenders. This is definitely worse than seeking a prostitute since it’s so damn violating. I really think his picture should be in every airport in the country, reminding others what NOT to do on a red-eye!

My guess is that rather than masturbating “still”, he was masturbating “again.” It says she slept for most of the flight. (I can say honestly that I have never put that word in the same sentence twice before!)

I absolutely agree! In fact, I would be rather surprised if this is truly his first offense…I haven’t heard any claims one way or another. But to be brazen enough to do that publicly makes me think that it is unlikely to have been his first violation.

I agree with you. Being ejaculated on by a total stranger is disgusting. Unless of course someone happens to be into that sort of thing, which obviously she isn’t. The airline should not be party in a lawsuit.
Having said that I see this story as nothing more than tort-reforming conservatives spreading the myth of corporations needing to be protected from individuals suing them. The dirty little secret here is that the vast majority of litigation in korporate amerika is of coporations suing each other. It’s not little old ladies spilling coffee all over themselves. I can site examples even in my small area where some insurance co. or convenience store chain picked a name that conflicted with a business already in operation, resulting in a lawsuit.
Korporate Amerika does not need to be protected from the public. The public needs to be protected from Korporate Amerika.

Very good point! I agree with that totally. However, the bottom line is the same either way. Greed is what is responsible for virtually any and all issues regarding Corporate America whether they are the claimants or the respondents. And I am sick of America’s selfish, money hungry ideology. Absolutely I couldn’t agree more. The airlines have nothing to do with this. It is quite possible they didn’t know what was going on. I’m sure the employees are not watching ever single passenger like a hawk.
She should press charges on the man where the blame belongs. End of story.
America is way to sue happy and it’s just disgusting. Suck it up people, somehow I don’t think having some strangers goo in you hair (as disgusting as it is) is worth the thousands or millions the airline will have to shell out to this greedy woman.
